    PROTECT Lambert Park!

    Over the past years, Alpine City has had to spend millions of tax payer dollars to protect Lambert Park. The park has been protected by City ordinance and now, a large group of citizens are working to promote a “Referendum” that could undo the millions of dollars we have all invested in protecting our park. We do not need this.

    The motive of citizens who are promoting the referendum is to get the city ordinance overturned, to remove the emergency access status of the road and to get the road paved permanently. This goes against all the work and money that has already been invested in the part.

    Why we Need a Conservation Easement?

    WITHOUT EASEMENT

    All that is needed to pave Lambert Highway is a vote of potentially only THREE city council members.

    WITH EASEMENT

    For the next ten years, the vote of FIVE council members will be required.

    THE TRUTH

    The easement DOES NOT give Lambert park to ANYONE and does not give anyone outside of Alpine any control in the decision to pave Lambert Highway.

    Every time citizens and outside parties attempt to change city ordinance and pave the road through Lambert Park, it costs tax payers potentially millions of dollars.

    The pending petition and associated referendum will cost Alpine tax payers approximately $10,000. The conservation easement will cost only $5,000.

    Why Utah County as the holder of the easement?

    The county is qualified by state statute to hold a conservation easement–few organizations are. Alpine City has the financial responsibility to defend the terms of the easement if Alpine citizens try to change its terms and pave the road. Every time a lawsuit occurs, it costs Alpine and Alpine tax payer dollars.

    A Conservation Easement is not a “Mandate”

    The terms of the Conservation Easement have flexibility. The terms are determined by the City and are subject to approval by the other contracting party and are subject to approval by the other contracting party that is obligated to defend it (the county).

    If the GRAVEL ROAD IS PAVED AND/OR EMERGENCY ACCESS IS REMOVED, THE DOOR IS OPEN FOR MORE ROADS THROUGH LAMBERT PARK

    The gravel road that goes through Lambert Park is, by Alpine city ordinance, delegated as an Emergency Access only road. This is part of Alpine City ordinance. Certain citizens are pushing (AGAIN after it has already been litigated at the cost of the city and Alpine Citizens) to get the road paved and remove its emergency access only status.

    There is no need for this given that there already is a main road from Box Elder into town. The purpose of an emergency access road is for emergencies and that is how the road should be used. Lets keep it that way. If this road is paved and/or the emergency access only status of this road is changed, then this opens up the opportunity to add more roads through Lambert Park. We will no longer have a place to hike and bike safely.
